Why Stronger Insurer Results Do Not Mean Liability Risk Has Gone Away

Small businesses still need to match cover to real-world claims exposure

Why Stronger Insurer Results Do Not Mean Liability Risk Has Gone Away?w=400

The information on this website is general in nature and does not take into account your objectives, financial situation, or needs. Consider seeking personal advice from a licensed adviser before acting on any information.

Fresh industry attention on APRA's general insurance performance data points to a healthier overall insurance sector, with stronger premium revenue, improved investment conditions and more stable underwriting outcomes across parts of the market.
For small business owners, that may sound like welcome news after several years of rising premiums and tighter insurer scrutiny.

However, stronger insurer results should not be mistaken for a simple promise of cheaper or easier liability cover. Public and product liability remain long-tail classes, meaning claims can take years to fully emerge, investigate, negotiate and settle. A slip-and-fall injury, accidental property damage at a client site, or a customer injury linked to business operations can still involve legal defence costs, expert evidence, medical assessments and compensation discussions long after the incident occurred.

This is an extension of the pressure points we have previously discussed around claims inflation. Even when the broader insurance cycle becomes more favourable, insurers continue to examine occupation, turnover, subcontractor use, past incidents, contractual requirements, safety systems and the severity of possible third-party losses. Two businesses in the same suburb can receive very different outcomes if one has high public foot traffic, works at height, hosts events or operates on other people's premises.

For tradies, retailers, hospitality venues, market stallholders, fitness operators and sole traders, the practical message is to review cover before renewal rather than assuming market conditions will do the work for you. Check whether your activities are accurately described, whether any exclusions affect your main source of income, and whether your public liability cover limit still aligns with contracts, leases, council permits or client expectations.

It is also worth looking beyond the headline premium. A lower price may be attractive, but a policy with a narrow business description, higher excess, restrictive conditions or gaps around subcontracted work can create problems when a claim is lodged. Claims service, documentation requirements and the speed of notifying incidents all matter when a customer, supplier or member of the public alleges injury or property damage.

Business owners should keep incident records, maintain risk controls, document staff training and review any venue, landlord or principal contractor insurance requirements. If your operations have changed, such as adding new services, taking on larger jobs, increasing foot traffic or working at more public sites, your insurance settings may need to change too. A stronger insurance sector is positive, but the best protection still comes from cover that reflects the way your business actually operates.
