Recent complaint trends reported by the Australian Financial Complaints Authority have again put insurance claims service under the microscope.
While much of the public attention often falls on home, motor and disaster-related cover, the message is just as relevant for small business owners: the moment a claim occurs is not the time to start working out what your policy requires.

For public liability insurance customers, claim disputes can arise from practical issues such as delayed notification, unclear evidence, uncertainty about whether an incident is covered, or disagreement over legal responsibility. A customer injury, damaged client property, or an incident involving a contractor can quickly become stressful if records are incomplete or communication with the insurer breaks down.

This is a useful extension of our earlier discussion on service standards across the general insurance sector. Regulators, complaints bodies and consumer advocates are continuing to focus on how insurers communicate, explain decisions and manage delays. For businesses, that scrutiny is welcome, but it does not remove the need to be organised before a liability event occurs.

A practical first step is to treat risk records as part of everyday business administration. Incident reports, photos, maintenance logs, staff training notes, contractor agreements and customer correspondence can all help clarify what happened. These records may support your insurer’s assessment and can also assist if a matter escalates into a legal demand or formal complaint.

Businesses may also choose to review whether their public liability limit still reflects their current exposure. A sole trader working from home has a different risk profile from a café, gym, market stall operator, tradie or event organiser dealing with regular foot traffic. If your business has grown, changed premises, taken on staff, added new services or started working on larger client sites, it may be time to estimate suitable cover limits rather than simply renewing last year’s policy unchanged.

The key lesson from the ongoing complaints focus is not that every claim will be disputed. Rather, it is that preparation improves your position. Read your policy wording, understand exclusions and notification conditions, keep evidence close at hand, and seek clarification before an incident happens. Public liability insurance remains a vital financial safety net, but it works best when paired with clear records, realistic cover levels and prompt action when something goes wrong.
